Terms of Service

These terms govern your use of the ExamMetrics website, datasets, intelligence tools, and Android application operated by Nextherion Technologies Private Limited. Please read them carefully before using the platform.

1. Acceptance of Terms

By accessing exammetrics.in or installing and using the ExamMetrics Android application, you agree to be bound by these Terms of Service ("Terms") and our Privacy Policy, which is incorporated herein by reference.

These Terms constitute a legally binding agreement between you ("User") and Nextherion Technologies Private Limited ("Company", "we", "us", "our"). If you are accessing the platform on behalf of an organisation, you represent that you have the authority to bind that organisation to these Terms.

Important

If you do not agree with any part of these Terms, you must immediately discontinue use of the platform and uninstall the application. Continued use constitutes full acceptance.

2. Platform Description

ExamMetrics is a decision intelligence platform that provides the following services:

Exam Datasets

Structured historical cutoff data, seat matrices, vacancy counts, and applicant-to-seat ratios for Indian competitive exams.

Rank Intelligence

Algorithmic tools that map user-entered marks to estimated rank ranges and historical percentile distributions.

Success Probability

Statistical models that estimate likelihood of selection based on historical patterns. Not a guarantee of outcome.

Exam Comparisons

Side-by-side analysis of exam difficulty, competition intensity, salary outcomes, and selection ratios.

The platform is informational in nature. Nothing on ExamMetrics constitutes official guidance from any exam-conducting authority (including NTA, UPSC, SSC, or any state public service commission).

3. Eligibility

You may use ExamMetrics if you meet all of the following conditions:

  • You are at least 13 years of age. Users between 13 and 18 require verifiable parental or guardian consent under the DPDP Act 2023.
  • You have the legal capacity to enter into a binding contract under applicable Indian law.
  • You are not prohibited from using the platform under any applicable law or court order.
  • You are not a competitor of ExamMetrics attempting to access the platform to scrape data, benchmark against our systems, or reverse-engineer our algorithms.

4. User Accounts

Certain features (including personalised predictions, saved score history, and exam tracking) require a registered account. By creating an account, you agree to:

  • Provide accurate, current, and complete registration information.
  • Maintain the security of your password. You are responsible for all activity that occurs under your account.
  • Notify us immediately at [email protected] if you suspect unauthorised access to your account.
  • Not create multiple accounts for deceptive purposes or to circumvent any restriction placed on your account.
  • Not share account credentials with third parties.

We reserve the right to suspend or terminate accounts that violate these Terms, provide false information, or engage in behaviour that harms other users or the platform.

5. Acceptable Use

5.1 Permitted Use

You may use ExamMetrics to access publicly available exam data, run rank predictions, compare exams, and track your personal preparation — for lawful, personal, non-commercial purposes.

5.2 Prohibited Conduct

The following are expressly prohibited:

Scraping & harvesting: Using automated tools, bots, crawlers, or scripts to extract, scrape, or mass-download data from ExamMetrics without written permission.
Commercial redistribution: Republishing, selling, licensing, or redistributing ExamMetrics datasets or intelligence outputs on any platform without prior written consent.
Reverse engineering: Attempting to decompile, disassemble, or reverse-engineer any part of the platform, including prediction algorithms and data models.
Interference: Attempting to overwhelm, disrupt, or degrade platform performance through denial-of-service attacks, injection attacks, or any other method.
Impersonation: Creating accounts using false identities or impersonating other individuals, organisations, or exam-conducting bodies.
Misinformation: Presenting ExamMetrics data as official cutoffs, ranks, or results from any exam authority, or otherwise misrepresenting the nature of our data.
Unlawful activity: Using the platform for any purpose that violates Indian law, including the IT Act 2000, IPC, or any state-level regulation.

Violation of these prohibitions may result in immediate account termination, legal action, and referral to appropriate law enforcement authorities under the IT Act 2000.

6. Data Accuracy Disclaimer

This is not official data

ExamMetrics aggregates and structures data from publicly available sources including official notifications, press releases, and government websites. We are not affiliated with, endorsed by, or acting as an agent of NTA, UPSC, SSC, any state public service commission, or any other exam-conducting body.

Rank and probability tools are estimates, not guarantees. Rank predictor outputs and success probability scores are derived from historical patterns and statistical models. Actual exam results depend on current-year performance, exam difficulty, category-specific cutoffs, and official processes entirely outside our control.

While we make every effort to ensure accuracy, exam data changes frequently. We do not warrant that cutoff figures, vacancy counts, or seat matrices are current, complete, or error-free. Always verify critical information directly with the official conducting authority before making any significant decision.

ExamMetrics shall not be liable for any decision made by a user in reliance on platform data, including decisions relating to exam attempts, college choices, or career planning.

7. Intellectual Property

All intellectual property rights in the ExamMetrics platform — including but not limited to the website, Android application, structured datasets, prediction models, algorithms, visual design, logos, and written content — are owned by or licensed to Nextherion Technologies Private Limited.

You are granted a limited, non-exclusive, non-transferable, revocable licence to use the platform for personal, non-commercial purposes. This licence does not permit you to:

  • Copy, reproduce, or create derivative works based on our datasets or content.
  • Use our brand name, logo, or trademarks without written permission.
  • Frame or embed any part of ExamMetrics in another website or application.
  • Remove any copyright, trademark, or attribution notices from any content.

Public exam data (official cutoffs, seat matrices, vacancy numbers) is sourced from government notifications and is in the public domain. Our structured representation of that data — including our database schema, scoring models, and comparative analysis — constitutes original work protected under the Copyright Act, 1957 (India).

8. Limitation of Liability

To the maximum extent permitted under applicable Indian law, Nextherion Technologies Private Limited and its directors, officers, employees, and agents shall not be liable for:

Any direct, indirect, incidental, consequential, or punitive damages arising from your use of or inability to use the platform.
Decisions made based on rank predictions, probability scores, or dataset information provided by ExamMetrics.
Temporary unavailability or interruption of the platform due to maintenance, technical failures, or events beyond our reasonable control.
Loss of data, content, or account information resulting from circumstances we could not have reasonably prevented.
Third-party content, links, or services accessible through or referenced by ExamMetrics.

Our total aggregate liability to you for any claim arising from these Terms or your use of the platform shall not exceed the amount you paid us in the 12 months preceding the claim — or ₹1,000 (Indian Rupees One Thousand) if the platform was accessed free of charge, whichever is greater.

9. Indemnification

You agree to indemnify, defend, and hold harmless Nextherion Technologies Private Limited and its affiliates, directors, officers, employees, and agents from and against any claims, liabilities, damages, losses, costs, and expenses (including reasonable legal fees) arising out of or related to:

  • Your violation of these Terms of Service.
  • Your violation of any applicable law or regulation.
  • Your misuse of platform data, including public redistribution or commercial use without authorisation.
  • Any content you submit or transmit through the platform.
  • Any claim that your use of the platform infringes the rights of a third party.

10. Termination

By you: You may close your account at any time via account settings or by emailing [email protected]. Account closure takes effect within 7 business days. Your personal data will be deleted in accordance with our Privacy Policy.

By us: We may suspend or permanently terminate your account without notice if you violate these Terms, engage in fraud, or engage in behaviour that harms the platform or other users. We reserve the right to discontinue ExamMetrics as a service at any time with 30 days' notice to registered users.

Effect of termination: Sections 6 (Data Accuracy Disclaimer), 7 (Intellectual Property), 8 (Limitation of Liability), 9 (Indemnification), and 11 (Governing Law) survive termination and continue to apply.

11. Governing Law & Disputes

These Terms are governed by and shall be construed in accordance with the laws of India. Any disputes arising from or relating to these Terms or your use of ExamMetrics shall be subject to the exclusive jurisdiction of the courts in Chennai, Tamil Nadu, India.

Dispute resolution process: Before initiating formal legal proceedings, you agree to first contact us at [email protected] to attempt to resolve the dispute informally. We will respond within 30 calendar days. If a resolution is not reached within 60 days, either party may pursue formal legal remedies.

12. Changes to These Terms

We may revise these Terms at any time. When we make material changes, we will update the "Last updated" date at the top of this page and provide notice through at least one of the following methods:

  • A prominent notice on the ExamMetrics homepage for at least 14 days before the changes take effect.
  • An email notification to registered users if the changes materially affect their rights or obligations.
  • An in-app notification on the Android application.

Your continued use of ExamMetrics after the effective date of revised Terms constitutes your acceptance of the changes. If you disagree, you must stop using the platform before the effective date.
